Your Sexual Freedom Is On Trial In Missouri

If you practice BDSM, your sexual freedom is going on trial in Missouri.  Early next year, Ed Bagley faces a federal trial where prosecutors are using the consensual BDSM relationship with his wife to prove a history of sexual abuse.  If the prosecution’s case is successful, it could make you a criminal for what you do in your own bedroom. According to court documents prosecutors filed last month,

“(Wife) Marilyn Bagley’s ‘consent’ to the sexual assaults by Defendant Edward Bagley does not change whether the acts legally constitute assault or not. Pursuant to the Missouri state assault statute … consent is not a defense to assault resulting in serious physical injury.”

What constitutes “serious physical injury” is poorly-defined and open to wild interpretation based on the judge’s own moral judgment. Get the wrong judge, in this case, or subsequent cases and you could be risking jail time for engaging in consensual BDSM, even with your own spouse!

I want to be clear that I do not know the details in this case.  The case against Ed Bagley is not about his wife, it’s about the alleged abuse of a 23 year-old “sex slave” who ended up in the hospital.  I’m not defending Bagley at all.  If he’s guilty of abuse or criminal negligence then he should be prosecuted.  What I’m concerned about is an overzealous court interpreting all BDSM as a non-consensual activity.

The National Coalition of Sexual Freedom is watching this case, so lawyers and people with far more resources than you and I are doing what they can.  My own contribution is to do what I do best and that’s make sure that this story is covered fairly and that I alert as many people as possible.  Information is power.
