Oklahoma County District Judge Bill Graves has denied two men who plan sex-change operations a switch to feminine names.  According to The Oklahoman, the judge wrote a seven page order where he explains,

“A so-called sex-change surgery can make one appear to be the opposite sex, but in fact they are nothing more than an imitation of the opposite sex,” and “Here, petitioner has not even had the surgery by which his sex purports to be changed. Thus, based on the foregoing and the DNA evidence, a sex change cannot make a man a woman or a woman a man all of which, the Court finds is sufficient in and of itself to deny petitioner’s request for a name change.”

Let’s put aside the fact that five of Judge Graves’ colleagues routinely grant name changes in transgender cases.  Let’s also set aside Judge Graves’ spurious justification to subvert the law for his own personal beliefs.  I’m well aware of the grotesque ignorance and insensitivity of some members of the Mesozoic era who still run the show in Oklahoma.

However, I’m calling bullshit on a conservative chestnut that decries “legislation from the bench.”  This is one of the clearest cases of judicial activism that I’ve ever witnessed.  If true conservatives in this state hate judicial activism then they should be outraged at this decision.  Unfortunately, the hillbillies that vote people like Judge Graves into office will see nothing wrong with what he’s doing, or are too busy watching Here Comes Honey Boo Boo to notice.

There’s an appeal on the first case, and hopefully Judge Graves will get a Smackdown like only The Rock can deliver.  Trying to mount a campaign to vote Graves out of office will make him into martyr for the bushwackers like Oklahoma’s other institutional embarrassment, State Representative Sally Kern.

I’ll leave you with a quote from the Oklahoma Bar Association on what constitutes a good judge and let you decide if Bill Graves lives up to these ideals.

The most important aspect of our judicial system is that justice is applied equally and fairly to everyone. The purpose of our judicial system is to uphold the law. Therefore, sitting judges and lawyer candidates for judicial office should be fair, unbiased, independent, can follow the law, have integrity and a good work ethic.

  1. What are the chances that this same judge would have no problem with granting permission for Women to change their names to their husbands’?

    It’s amazing how these yahoos use science to support their biases and religious mythology to negate science when convenient – and particularly where education is involved.

    There is no intelligence to this design; there is only hatred.

    So much for the American Dream of life, liberty & happiness.
